TERMS AND CONDITIONS OF PERSONAL USE – 11JAI

Thank you for using 11JAI, an artificial intelligence software developed by ONZE.NEWS TECNOLOGIA DA INFORMAÇÃO LTDA. (“ONZE”).

By accepting these Terms, you agree to all conditions set forth herein.

1. DEFINITIONS

For the purposes of this document, the following definitions apply:

• 11JAI: Artificial intelligence tool developed to assist journalistic production.
• User: Professional who will use the 11JAI tool.
• Manager: Administrator responsible for the institutional account of the media outlet.
• Credits: Consumption units required to use the tool.
• Contributions (Inputs): Data, prompts, information, and commands provided by the User to the system.
• Results (Outputs): Texts, information, and materials generated by the 11JAI tool based on the Contributions.
• Third-Party Services: Software, APIs, integrations, and products provided by third parties, subject to their own terms of use.
• LGPD: Brazilian General Data Protection Law (Law No. 13.709/2018).

2. DATA COLLECTION AND SHARING

2.1 Data Storage

11JAI will store the following data:

• Full content of the generated Results;
• Date and time of generation;
• Versions of generated Results;
• Personal data of the User responsible for the generation;
• Metadata associated with the production.

2.2 Sharing with Managers

The collected data may be shared with the Managers of the User’s institution for the purposes of:

• Productivity analysis;
• Resource management;
• Process optimization;
• Quality control.

ONZE shall not be held responsible for any data processing carried out directly by the Managers or the contracting institution, who shall bear full responsibility for appropriate use in compliance with the LGPD.

3. USAGE METRICS

3.1 Collected Data

The following data will be recorded:

• Full name, email address, phone number, and CPF of the User;
• User’s date of birth;
• Total number of texts generated;
• History of generation dates and times;
• Credit consumption;
• Usage patterns (peak and off-peak hours);
• Average production time;
• Utilization rate of the Results;
• Full content of the Results.

The User declares that the information provided is truthful and shall be liable for any damages resulting from false or incomplete data.

4. PERSONAL DATA AND DATA PROTECTION

4.1 Data Collection

For account personalization and access, the following data may be collected:

• Full name;
• CPF;
• Email address;
• Phone number.

4.2 Data Processing

In compliance with the LGPD:

• CPF, email, and phone number will be encrypted;
• Access restricted to authorized personnel only;
• Data used solely for identification and authentication purposes;
• Stored on secure servers.

4.3 Data Subject Rights

The User may, at any time, request:

• Access, correction, or deletion of personal data;
• Data portability;
• Withdrawal of consent.

4.4 Registration and Access

• The User must provide accurate and complete data;
• Sharing of credentials is prohibited and may result in account suspension;
• The User is responsible for all activity carried out under their account.

4.5 Communications

The User authorizes the sending of operational and commercial communications from ONZE and its partners.

The User may request to unsubscribe from commercial communications, without affecting mandatory operational communications.

5. RANKINGS AND VISIBILITY

5.1 Scoring System

Users may be ranked based on the following criteria:

• Number of texts produced;
• Consistency of use;
• Efficiency in credit usage.

5.2 Data Disclosure

The User agrees to the public disclosure of the following information:

• Full name;
• Affiliated media outlet;
• Production metrics;
• Ranking position.

ONZE shall not be held liable for any damages resulting from such disclosure.

5.3 Types of Rankings

• General Ranking: visible to all platform Users.
• Institutional Ranking: specific to each media outlet.

6. USER PROHIBITIONS

The User shall not:

• Use 11JAI for illegal, abusive, or unlawful purposes;
• Infringe upon third-party intellectual property rights;
• Copy, sublicense, sell, distribute, or exploit the Services without authorization;
• Perform reverse engineering, decompile, or attempt to discover the source code;
• Extract data in an automated or programmatic manner;
• Use the Results to train competing systems;
• Represent the Results as exclusively human-authored without acknowledging the use of AI.

7. RIGHTS AND RESPONSIBILITIES

7.1 User Rights

• Request deletion of personal data;
• Request a usage report;
• Request technical support.

7.2 User Responsibilities

• Keep registration data up to date;
• Use the tool ethically and responsibly;
• Ensure they hold rights to the Contributions provided;
• Be liable for any legal or contractual violations resulting from the use of the Results;
• Maintain confidentiality of access credentials.

8. USE OF CONTENT (INPUT AND OUTPUT)

• The User retains ownership rights over their Contributions.
• The User holds title to the Results but acknowledges that these may not be exclusive and that other users may receive similar outputs.
• ONZE may use Contributions and Results for maintenance, development, and improvement of the Services, in accordance with applicable law.
• The User assumes full responsibility for the Contributions, ensuring they do not infringe third-party rights or violate the law.

9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

• 11JAI is provided “as is”.
• ONZE does not warrant that the Services will be error-free, uninterrupted, or suitable for specific purposes.
• ONZE shall not be liable for indirect damages, loss of profits, data loss, or any harm resulting from use of or reliance on the Results.

10. TERMINATION, SUSPENSION, AND DISCONTINUATION

ONZE may suspend or terminate the User’s access in the event of:

• Violation of these Terms;
• Legal or reputational risk;
• Abusive or unlawful use;
• Inactivity exceeding 12 months.

ONZE may discontinue the Services with prior notice and a proportional refund of any paid and unused amounts.

11. UPDATES TO THE TERMS

• Material changes will be communicated at least 30 days in advance;
• Emergency changes may be implemented immediately;
• Continued use after changes implies acceptance of the updated terms.

12. CHOICE OF JURISDICTION

The Central Court of São Paulo/SP is elected as the exclusive jurisdiction, with express waiver of any other, however privileged it may be.

13. ACCEPTANCE STATEMENT

By clicking “I accept the Terms and Conditions,” the User declares that they have read, understood, and agreed to all conditions set forth herein.
